The Ile de France Gourmet Cheese Baskets Sweepstakes (Sweepstakes) begins at 12:00:01 am Eastern Time on Tuesday, March 4, 2008 and ends at 12:59.59 pm Eastern Time on Wednesday, December 31, 2008 (Sweepstake period) Sweepstakes sponsored by ANCO Fine Cheese, a division of Schratter Foods Inc., 333 Fairfield Road, Fairfield NJ 07004 ("Sponsor"). ELIGIBILITY: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. Sweepstakes participation is open only to legal residents of the 50 United States and District of Columbia ("D.C.") who are 21 years of age or older at the time of entry. Employees, suppliers, officers and directors of Sponsor, its parent companies, affiliates, subsidiaries, advertising, promotion, fulfillment agencies, legal advisors, the immediate family members, and person living in the same household of such employees are not eligible. Additional restrictions may apply. ENTRY: An eligible individual receives one entry into the Sweepstakes when he/she completes and transmits the entry form found on the website iledefrancecheese.com/sweepstakes_home.html. Web site entries must be received by 11:59:59 p.m. Eastern Time Wednesday, December 31, 2008 and will be tracked by ANCO Fine Cheese, a division of Schratter Foods Inc. An eligible individual receives one automatic entry into the Sweepstakes when he/she submits the requested information consisting of a first name and an e-mail address and a valid Zip code that will be valid from 12:00:01 am Eastern Time on Monday, March 3, 2008 and ends at 12:59.59 pm Eastern Time on Wednesday, December 31, 2008. Sweepstakes participation is limited to one entry per eligible individual per week during the Sweepstakes Period. All entries become the property of Sponsor. PRIZE: One (1) Grand Prize will be awarded for each week of the Sweepstakes Period. The Grand Prize is One (1) box Les Folies Fromage Fruit Spreads for Cheese (Size: 4.2 ounces) One (1) box Ile de France Le petit pain grille (Size: 3.5 ounces) One (1) bag Just Figs Slow Fruit (Size: 2.3 ounces) One (2) boxes Grab An O Olives (Size: 4.4 ounces) One (1) bag Just Green Apple Slow Fruit (Size: 1.4 ounces) One (1) wheel of Ile de France Brie (2.2 Lbs) One (1) buchette Ile de France flavored fine herbs (10.5 oz) One (1) buchette Ile de France plain goat cheese (10.5 oz) The Sponsor shall solely determine the specifics of the prize. In the event that a particular product is out-of-stock at the time of the prize delivery, the sponsor will replace the item with the same product(s) in varying sizes, in order to equal the original weight of the unavailable product. No cash or other prize substitution shall be permitted except at Sponsor's discretion. The prize is non-transferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. There is a limit of one Grand Prize per eligible participant per each week of the Sweepstakes Period. SELECTION OF WINNER: The Grand Prize winner for each week of the Sweepstakes Period will be determined by random drawing from all eligible entries received during the week for which the prize is being awarded. Each drawing shall occur on Monday at 6PM EST of each week of the Sweepstakes Period. The total number of eligible entries received on the week for which a prize is being awarded will determine the odds of winning. Within five (5) days of each weekly drawing, each winner will be notified by e-mail at the address provided at the time of contest entry. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners. Sponsor is not responsible for notifications that are misdirected because of email addresses that are no longer correct, or for any other reason beyond the control of Sponsor. The winner will be required to provide his/her mailing address and sign and return a release of liability, declaration of eligibility, and where lawful, a publicity consent agreement, all within 2 days of receiving the acknowledged notification. If the winner has not attained the age of majority in his/her state of residence, he/she will be disqualified because they were not eligible to participate based upon the age limitation above. By accepting and/or using a prize, the winner consents to the use of his/her name, voice and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law, and upon request will provide such consent in writing. If the selected winner can not be contacted, is ineligible, fails to claim the prize within 2 days from the time, the award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize shall be forfeited at Sponsor's discretion. Winners can expect to receive their prize approximately 4 weeks (and no more then 6 weeks) following the announcement of their win after they provide their mailing address and any other required information. However, depending on Sponsor's available inventory, delivery of some prizes may take longer. This is to ensure freshness, quality and customer satisfaction. The receipt by a winner of the Grand Prize is conditioned upon the winner's compliance with any and all federal, state and local rules and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY PARTICIPANT OR WINNER MAY, AT SPONSOR'S SOLE DISCRETION, RESULT IN SUCH PARTICIPANT'S OR WINNER'S DISQUALIFICATION AS A PARTICIPANT OR WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS PARTICIPANT OR WINNER MAY BE IMMEDIATELY TERMINATED BY SPONSOR. GENERAL TERMS AND CONDITIONS: By entering, each participant agrees (a) to be bound by these Official Rules and the decisions of Sponsor, which shall be final, and (b) that Sponsor, agents and representatives of Sponsor, its parent companies, affiliates, subsidiaries, officers, directors, employees, legal advisors and advertising, promotion, fulfillment agencies are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible, postage-due entries, mail, or e-mail; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted or cancelled; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy; or (vi) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right at its sole discretion to disqualify any individual or entity it finds to be attempting to defraud or in any way tamper with the Sweepstakes. WINNER'S LIST AND OFFICIAL RULES: Obtain a list of the winners' names or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope, to: ETL Advertising, 39W 38th Street, New York, NY 10018. Requests must be received no later than January 31, 2009. WAIVER: By entering the Sweepstakes, potential winners waive all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs incurred to enter. By entering Sweepstakes, potential winners agree that Sponsor shall not be held liable for any injuries, losses or damages resulting from participation in this Sweepstakes or acceptance, possession and use of any prize. Sponsor reserves the right, in its sole discretion, to cancel, suspend or modify the Sweepstakes should fraud, virus, bugs or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the Sweepstakes.
